1. General StipulationsThe Terms and Conditions outlined below apply to all orders made with and distributions from First Swiss Luxury GmbH.
We reserve the right to change the last revised General Terms and Conditions.
Variations from the above Terms and Conditions are only legally binding if we have agreed in writing the alterations.
We explicitly reject any testiment made to the customer’s general terms and conditions.
In these terms and conditions:
"We" and "us" means First Swiss Luxury GmbH.
"You" and “the customer” means the person placing an order.
“Both parties” means First Swiss Luxury GmbH and the person placing the order.
2. Products
a) We only sell original brand name watches.
b) Unless otherwise stated under the details of the watch description, we sell and deliver all new watches in their original casing, this consists of full instructions, manufacturer’s certified warranty certificate and presentation box.
c) The condition of all Second hand/used watches offered by us will be expressly described on a case by case basis. This description will indicate their:
· condition and
· The availability of the products original casing, certification and warranty.
d) We are not authorized dealers of any brands mentioned on the website.
e) We are not connected to any of the watch manufacturers listed on this website.
3. Prices
a) All prices include (‘prices’ are all prices which are shown on the website or conveyed through e-mail):
· Insurance
· Shipment (worldwide & handling)
b) First Swiss Luxury quotes prices in USD, Euros, and Swiss Francs (CHF).
c) We offer quotes in the following currencies:
· USD
· Euros
· Swiss Francs
d) Customers favoured currency can be chosen when an order is placed.
e) The customer will receive verification of chosen currency once the order has been confirmed by us. Any alterations to the chosen currency may only take place before payment and only if both parties reciprocally agree.
f) We reserve the right to change prices at any time without notice which are:
· shown on the website or
· relate to an request for information made and conveyed through e-mail.
g) First Swiss Luxury GmbH reserves the right to change prices without prior notice.
4. Taxes & Duties
Taxes and duties will automatically be included in any prices shown in relation to all sales to the US.

5. Orders
a) By completing and submitting an electronic order form, or an ordering by telephone you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Orders can be made on our website 24hrs per day and over the phone between our working hours from 8 am to 7 pm. Central European Time
b) You can track any order placed at sales@first-swiss-luxury-watches.com
c) We reserve the right to refuse an order.
6. Payment Options
a) Payment of the full purchase price is required from the customer to First Swiss Luxury GmbH before an order is shipped. On the occasion that a watch is not in stock we reserve the right to request a deposit payment. You will be informed of this requirement on placement of order.
b) Methods of Payment.
I. Payment can be made (of the full purchase price as indicated at the time of sale) by any of the following ways:
· Wire Transfer
· Cheque (We reserve the right to refuse a cheque)
N/B If paying by means of cheque shipment of the purchased item will only take place once the clearance of the cheque has taken place through our chosen bank.
N/B To use this method of payment the cardholder’s name and billing address must correspond to the same delivery details.

7. Delivery
a) You will receive your purchase via UPS Express shipping service. We communicate all tracking numbers via e-mail once the order has been despatched.
b) UPS Express offers:
· "worldwide delivery”
· to over 200 countries
· Estimated delivery time one to two days, depending on the destination". (Source: http://www.UPS.com).
N/B We do not make any express or implied guarantees with regard to UPS shipping times and excludes all liability relating there to.
c) We have undertaken to insure all deliveries through First Swiss Luxury GmbH.
d) Collection of purchases is also available. Please contact sales@first-swiss-luxury-watches.com to arrange a collection.
8. Delivery Time
a) Once payment has been received, all watches in stock are shipped immediately.
b) On occasion that a watch is not in stock we will notify you via e-mail on placement of your order with the expected delivery date. In the event of any changes to this we will contact you via e-mail
c) You can track the position of an order by calling +41 43 222 40 62 or sales@first-swiss-luxury-watches.com
d) In the unlikely event that we are not able to supply a watch and the order has been accepted by us, we will refund the full amount paid to the customer.
N/B We will not be liable and will not reimburse any further costs that may have been suffered in relation to the order.
9. Transfer of Title and Risk
a) It is upon shipment of the watch that title and risk is passed
b) On the occasion of customer collection of the watch from Switzerland, title and risk is passed upon collection of the watch.
10. Warranty
a) Unless otherwise specifically stated, all manufacturer’s warranties are for a period of 24-60 months. This is dependent on the watches make and model.
b) We offer a 3-12 month warranty on all second hand/used watches.
c) Watches can be taken to a manufacturer’s approved dealer for any necessary repairs.
N/B This can only take place within the warranty period
d) We also accept watches returned to us for repair during the warranty period and repair or arrange to repair all defects at no cost to the customer.
N/B Defects will only be repaired under the following conditions:
· Defects have to have occurred within the warranty period, and
· We have to have been made aware of this defect immediately, in writing.
· The defect was not caused by any negligence by the customer, incorrect treatment or inadequate maintenance.
11. Legal Responsibility
a) First Swiss Luxury GmbH shall only be liable for watch defects which appear and have been properly notified in writing within the warranty period, provided the defect was not caused by improper use, insufficient maintenance or negligence by the customer.
b) Where paragraph (a) above applies, the customer agrees that we will repair the defect, to the exclusion of all other available remedies.
c) We shall be hereby excluded from any liability for indirect damages caused or materially contributed to by the UPS distribution system.
12. Return Policy
a) During the warranty period only, watches be returned to us and only under the following reasons:
· an incorrect watch has been delivered
13. Data Protection and Privacy
a) We strive to protect our customer’s privacy and the safe transfer of all data to the best possible standard as is reasonable. We undertake the following precautions to achieve this:
b) Use of Data:
· All personal data is treated in the strictest confidence.
· We only request information required to fulfil an order.
· We may also use your personal information to contact you about news and offers that we think may interest you, or to tell you if we change anything important about how the website works, or the terms of use of the website.
c) Transfer of Data:
· We only transfer data when essential to fulfil the agreement with the customer.
· We will not transfer, send or sell any personal data to third parties.
d) Storage of Data:
· All personal data provided is stored for internal use only, to aid purchases for current customers
· All data is stored in a secure computer system and kept for as long as is permitted by law.
e) Credit Card Data:
· All purchases undertaken by way of credit card are made using a PDF form downloadable from here. The completed form is received by us via fax. And to this end credit card details are never transferred via the internet.
· Any purchase made through us First Swiss Luxury GmbH will show as on credit card statements.

14. Applicable Law & Jurisdiction
a) This agreement is subject to Swiss law, excluding the conflict of law rules.
b) The place of jurisdiction for any disputes arising from this or in connection with this agreement will be where First Swiss Luxury GmbH registered office is located.
15. Statement of liability
The First Swiss Luxury GmbH has tried his best to make the bidding email and the contents of website, but the company is completely not liable to the correctness, reality, integrality, accuracy and availability of the contents which he published. The First Swiss Luxury GmbH can modify or delete the contents on the website and the bidding contents at any time.
The First Swiss Luxury GmbH should not bear any liability, if any property loss or material loss caused by using the company website.
The First Swiss Luxury GmbH will check the interrelated links to the website, but need not bear liability to the correctness and legal character of the incorrect links.
